INTRODUCTION

1. SKA Risk Solution Services , operates an online website (“Site”) which allows customers to view, compare and purchase insurance products, direct purchase of insurance products which includes motor insurance, medical insurance, home insurance, personal accident and commercial insurance and any other related services for free (“Services”) by our insurance partners to customers (collectively referred to as “Users”).
2. By using our Site and/or Services, you are deemed to have consented to be bound by this Terms of Use (“Terms”) which shall constitute a legally binding agreement (“Agreement”) between you and SKA Risk Solution Services , its parents, subsidiaries, affiliates officers and directors (collectively referred to as “SKA Risk Solution Services ”). Should you not be agreeable to the Terms hereinafter contained, kindly do not use our Site and/or Services.
3. SKA Risk Solution Services  may amend or supplement these Terms from time to time. Any amendment or addition to these Terms shall be effective immediately upon the posting of the amendment or addition on our Site. Your continuous usage of our Site and/or Services after such postings shall be deemed as you having agreed to be bound by our amendments and/or additions to these Terms.

INTELLECTUAL PROPERTY RIGHTS

1. Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of Malaysia, foreign jurisdictions, and international conventions. The Content and the Marks are provided on the Site “AS IS” for your information and personal use only. Except as expressly provided in these Terms of Use, no part of the Site and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.
2. Provided that you are eligible to use the Site, you are granted a limited license to access and use the Site and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use. We reserve all rights not expressly granted to you in and to the Site, Content, and the Marks.

PURCHASE OF INSURANCE PRODUCTS ON OUR SITE

1. SKA Risk Solution Services is a registered Insurance Agency of our partner Insurers. Please note that the insurance products that you purchase through our Site are products of our Insurers.
2. Payment: Any monetary transaction made on our Site uses an authorised payment gateway service provider by Bank Negara Malaysia. Nevertheless, we do not provide any assurance that the information provided by the User when using the payment gateway is secured and will not be intercepted by any third party. We do not accept or assume any liability should there be any unauthorised interception, hacking or misappropriation of the information provided by the User of our Site.
3. Cancellation and Refund: Should you intend to cancel any exiting policy in your name, you may do so by directly contacting the Insurer of the insurance product. The Insurer shall in their discretion determine the amount to be refunded to you for the cancellation of the insurance policy subject to your eligibility and other terms and conditions to be set by the Insurer.
4. Claims procedure: Should you have any claims to be made under your insurance product purchased on our Site, please note that you will have to deal directly with the Insurer providing the insurance product.
5. Delivery of Insurance Policy Contract: You will receive your insurance policy contract via email or courier service at the addressed you had provided to us.

PROHIBITED ACTIVITIES

1. You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us. You agree that you shall not reproduce, duplicate, copy, sell, trade, resell or exploit for commercial purposes any portion of the Site except where expressly provided herein or where we have provided our prior written consent.
2. You may not impersonate any third person, entity, provide false statements or make any misrepresentation on your affiliation with any person or entity in connection with the Site, or to represent whether expressly or impliedly that we endorse any statement made by you.

GOVERNING LAW

1. These Terms shall be governed by, and construed in accordance with, the laws of Malaysia and submit to the exclusive jurisdiction of the courts of Malaysia.

SUSPENSION

1. By using our Site, you agree that you will be personally liable for the use of the Site and for all communication and activity between other Users of our Site. Should it be discovered that you are involved in any prohibited activities on our Site, are disrespectful to other Users or in any event in violation of our Terms of Use, we may deny your access to our Site on a temporary or permanent basis, depending on the seriousness of non-compliance.
2. We reserve the right to suspend, terminate, change or discontinue any features on our Site and our sole and absolute discretion at any time with no notice to you.

LIMITATION OF LIABILITY

1. To the fullest extent permitted by the law, we exclude all liability and responsibility arising from and in connection to your use of the website including and not limited to:
2. Actual or foreseeable loss of profits, revenue, savings, data and any indirect consequential punitive or exemplary losses; and
3. Any other losses regardless if we or our representatives have been advised of the possibility of such damages.

 USER REPRESENTATIONS, WARRANTIES AND INDEMNITIES

1. You warrant that the information you had provided, submitted and/or uploaded on the Site is true and accurate and you shall be solely responsible for the same.
2. The User hereby agrees that they are liable to indemnify SKA Risk Solution Services  against any loss, damage and/or legal fees arising from any occurrence of SKA Risk Solution Services  being subjected to any legal proceedings and/or dispute as a result of any act or negligence of the User in connection to the Services and use of the Site.
